Land Development

Residential and commercial developers, brokers, legal firms, land conservation groups, government agencies, and private entities look to ERO for assistance in navigating the various stages of environmental due diligence associated with property acquisitions. ERO brings decades of experience and institutional knowledge to the preparation of Phase I Environmental Site Assessments (ESAs). Our ESA work supports environmental liability protection, lender requirements, and risk management.

ERO’s Phase I ESAs meet or exceed the ASTM Standard Practice for Environmental Site Assessments and the Environmental Protection Agency All Appropriate Inquiry rule to satisfy one of the requirements to qualify for the innocent landowner, contiguous property owner, or bona fide prospective purchaser limitations on Comprehensive Environmental Response, Compensation, and Liability Act liability.

ERO has the staff and institutional knowledge to effectively conduct follow-up site investigations, often called Phase II ESAs or Limited Site Investigations. ERO has conducted hundreds of such investigations with respect to recognized environmental conditions identified on properties ranging from urban commercial or industrial to agricultural land used for oil and gas production or mining.

Property owners often need to redevelop contaminated properties or properties with perceived contamination. ERO has extensive experience assisting clients with the Colorado Department of Public Health and Environment (CDPHE) Voluntary Cleanup Program (VCP). This program provides property owners with the ability to facilitate environmental cleanups, as well as assurance against regulatory enforcement.
